Terms of Service
Legally-binding terms governing your use of TheBigBot.
1. Acceptance of Terms
By accessing or using TheBigBot (the "Service"), you agree to be bound by these Terms of Service. If you disagree with any part, you may not access the Service. TheBigBot is operated by TheBigBot LLC.
2. The Service
TheBigBot provides an AI-powered CRM and marketing automation platform including AI receptionist, SMS/email marketing, workflow automation, lead management, and related services. We reserve the right to modify, suspend, or discontinue any aspect of the Service with reasonable notice.
3. Accounts & Eligibility
You must be at least 18 years old and legally able to enter into binding contracts. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
4. Subscription & Billing
Subscriptions are billed monthly in advance. Usage fees (SMS, phone calls, email, AI tokens, phone numbers) are billed at the end of each billing cycle. Prices are listed on our Pricing page and Usage Fees page. We reserve the right to change pricing with 30 days' notice.
5. Acceptable Use
You agree to use the Service in accordance with our Acceptable Use Policy. You may not use the Service for spam, harassment, illegal activities, or to violate any person's privacy or rights. Violations may result in immediate suspension or termination.
6. Compliance (A2P, CTPA, GDPR, CCPA)
You are responsible for compliance with all applicable laws including TCPA, A2P 10DLC registration, CAN-SPAM, GDPR, CCPA, and any other consumer protection or data privacy laws in your jurisdiction. See our A2P/SMS Compliance page.
7. Your Data
You retain all rights to the data you upload. We process your data in accordance with our Privacy Policy. You grant us a limited license to use your data solely to provide and improve the Service.
8. Intellectual Property
The Service, including all software, designs, and content (excluding user-generated content), is owned by TheBigBot LLC and protected by copyright, trademark, and other laws.
9. Limitation of Liability
To the maximum extent permitted by law, TheBigBot LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability is limited to the amount you paid in the preceding 12 months.
10. Termination
You may cancel your subscription anytime from your dashboard. We may terminate or suspend your account for violations of these terms. Upon termination, you may export your data within 30 days.
11. Governing Law
These terms are governed by the laws of the State of Delaware, USA. Any disputes shall be resolved through binding arbitration in Delaware.
